Good afternoon,
Under the Rhode Island Access to Public Records Act, §38-2-1 et seq., I am requesting an opportunity to obtain digital copies of public records that pertain to private markets investment vehicles that the Rhode Island Municipal Employees’ Retirement System (MERS) has contributed capital to (i.e. Private investments such as Private Equity, Private Debt, Real Estate, Infrastructure etc.). Moreover, the data that we seek to obtain includes but is not limited to:
Fund Name, Vintage Year, Market Value/Total Value, Total Commitment, Total Contributions, Total Distributions, Adjusted Remaining Value, Gain/Loss, Net Return, Gross IRR, Net IRR, TVPI, DPI, Management Fee Information, Partnership Expenses, and Carried Interest
If there are any fees for searching or copying these records, please inform me if the cost will exceed $100. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of the private markets investment industry. To lend perspective into why eVestment is in search of the aforementioned data points, we are looking to compile a universe of data for the private markets industry. Our purpose is to provide investors transparent and objective insight in the private markets due-diligence process.
The Rhode Island Access to Public Records Act requires a response time within seven business days. If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

If you contend you have been denied access to public records, pursuant to Rhode Island General Laws §38-2-8, you may appeal this decision to Amy L. You may also file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI 02903 or the Rhode Island Superior Court of the county where the records are maintained.
