We write in response to your October 11, 2019 request for information pursuant to the Rhode Island Access to Public Records Act (APRA).  Your specific request is noted below along with our corresponding response.

On July 26, WatchdogRI submitted an open records request for pension data for the North Providence Fire Department, the reply to which was received on 8/9/2019.  We would like to issue this same APRA request for every pension maintained by the RI Treasurer’s office.  We have a few questions. For a municipality that has multiple departments covered under MERs, is it possible for the data that comes back to us to include which municipal department the pensioner worked?  We would also like for this request to cover all teacher pensions, state worker pensions (including State Police) and also the judiciary.  The data that was sent to us last time for both active and retired individuals was responsive to our request.

Please find attached the documents responsive to your request.  Note that pursuant to Rhode Island General Laws § 38-2-3(h), the Office of the General Treasurer is not required to reorganize, consolidate, or compile data not maintained by the Office in the form requested.  Such information includes “last job title”, which the Office does not maintain.  Further note that certain information has been withheld pursuant to R.I. Gen. Laws § 38-2-2(4)(A)(I)(b) as it consists of personal individually identifiable information, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy.  Such information includes full dates of birth, full addresses, and names of beneficiaries who have yet to receive a pension. 

If you contend you have been denied access to public records, pursuant to R.I.G.L. § 38-2-8, you may appeal this decision to Frank Karpinski, Executive Director, 50 Service Avenue, 2nd Floor, Warwick, RI 02886.  You may also file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI  02903 or the Rhode Island Superior Court of the county where the records are maintained.
