To Whom It May Concern,
Under the Rhode Island Access to Public Records Act, §38-2-1 et seq., I am requesting an opportunity to inspect or obtain copies of public records that relate to the Board elections for the
Employees' Retirement System of Rhode Island, including any Request for Proposal, Questions and Answers as well as the Proposal Responses provided by interested vendors.
If there are any fees for searching or copying these records, please inform me if the cost will exceed $10. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of Processes and costs associated with these elections. This information is not being sought for commercial purposes.
The Rhode Island Access to Public Records Act, §38-2-1 et seq. requires a response within three business days. If access to the records I am requesting will take longer than this time period, please contact me with information about when I might expect copies or the ability to inspect the requested records.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

We write in response to your January 25, 2019 request for information pursuant to the Rhode Island Access to Public Records Act (APRA). Your specific request is noted below along with our corresponding response.
Under the Rhode Island Access to Public Records Act, §38-2-1 et seq., I am requesting an opportunity to inspect or obtain copies of public records that relate to the Board elections for the Employees' Retirement System of Rhode Island, including any Request for Proposal, Questions and Answers as well as the Proposal Responses provided by interested vendors.
The Employees’ Retirement System of Rhode Island (“ERSRI”) does not maintain documents responsive to your request as ERSRI does not use an outside vendor to handle board elections. The ERSRI board elections are run by the State of Rhode Island Board of Elections: http://www.elections.ri.gov/. However, you can find the minutes of board meetings during the past election period at the following link: https://opengov.sos.ri.gov/openmeetings. The last board election was held in January of 2016. If you contend you have been denied access to public records, pursuant to R.I.G.L. § 38-2-8, you may appeal this decision to Frank Karpinski, Executive Director, 50 Service Avenue, 2nd Floor, Warwick, RI 02886. You may also file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI 02903 or the Rhode Island Superior Court of the county where the records are maintained.
