We write in response to your September 26, 2019 request for information pursuant to the Rhode Island Access to Public Records Act (APRA).  Your specific request is noted below along with our corresponding response.

Under the Rhode Island Open Records Act, I am requesting an opportunity to inspect or obtain copies of public records including any Request for Proposal/Quotation/Bid/Contracts, related responses (proposals/quotations/bids), and resulting contracts relating to election of and voting for Board members (Trustees, Directors, etc.) for Employees’ Retirement System of Rhode Island. We are requesting to review paperwork for the last election that was held.

As stated in our response to your previous request for this information, the Employees’ Retirement System of Rhode Island (“ERSRI”) does not maintain documents responsive to your request as ERSRI does not use an outside vendor to handle board elections.  The ERSRI board elections are run by the State of Rhode Island Board of Elections: http://www.elections.ri.gov/.  You may wish to submit a request for records to that agency.  To the extent they may be helpful, you can find the minutes of board meetings during the past election period at the following link: https://opengov.sos.ri.gov/openmeetings.  The newsletters announcing the elections and the results can be found here: http://www.ersri.org/actuarial-valuations/compass-newsletter/#gsc.tab=0.      

If you contend you have been denied access to public records, pursuant to R.I.G.L. § 38-2-8, you may appeal this decision to Frank Karpinski, Executive Director, 50 Service Avenue, 2nd Floor, Warwick, RI 02886.  You may also file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI  02903 or the Rhode Island Superior Court of the county where the records are maintained.
