We write in response to your August 21, 2019 request for information pursuant to the Rhode Island Access to Public Records Act (APRA). Your specific request is noted below along with our corresponding response.
I would like to formally request a copy of your counties' “excess funds list,” which I believe is maintained by your department.
The excess funds to which I am referring to are those arising in the case of a bid over the amount of property taxes owed at tax sale.
I am only looking for uncollected surplus funds on unredeemed properties.
The information I need from the records is the tax sale date, owner’s name, either the property address or owner’s mailing address, and the amount of surplus funds due to the owner for properties in the last 12 months.
The Office of the General Treasurer does not maintain documents responsive to your request. You may wish to contact the Rhode Island Department of Revenue or the particular cities and towns from which you seek this information. To the extent you are seeking information about unclaimed property, you may find responsive information here: https://findrimoney.com/.
If you contend you have been denied access to public records, pursuant to R.I.G.L. § 38-2-8, you may appeal this decision to Amy L. Crane, General Counsel, 50 Service Avenue, 2nd Floor, Warwick, RI 02886. You may also file a complaint with the Department of the Attorney General, 150 South Main Street, Providence, RI 02903 or the Rhode Island Superior Court of the county where the records are maintained.
